By accessing or using Pantry (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. Pantry is operated by PantryDonate (“we”, “us”, “our”), based in Hallowell, Maine.
You must be at least 18 years old to create an account. By registering, you represent that you are of legal age and have the capacity to enter into a binding agreement.
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to notify us immediately of any unauthorized use of your account. You may not create accounts for the purpose of fraud, impersonation, or misrepresentation.
Pantry is a technology platform that connects food donors with food banks and pantries. We facilitate the posting, discovery, and coordination of food donations. We do not take possession of, inspect, or guarantee the quality, safety, or suitability of any donated food items.
Pantry is a platform, not a food handler. We do not inspect, prepare, store, or transport food (except when third-party courier services are used at the user’s request). Donors are responsible for ensuring that donated food is safe, wholesome, and donated in good faith.
Under the Bill Emerson Good Samaritan Food Donation Act (42 U.S.C. § 1791), donors who donate food in good faith are protected from civil and criminal liability for any harm resulting from the donated food, except in cases of gross negligence or intentional misconduct.
Pantry generates estimated fair market value (FMV) calculations for donated food using USDA Agricultural Marketing Service commodity pricing data. These estimates are provided for informational purposes only and may not reflect the actual fair market value of specific items.
Tax receipts generated by Pantry are donation acknowledgments. Pantry is not a tax advisor. We do not provide tax, legal, or accounting advice. Users should consult a qualified tax professional to determine the deductibility of their donations.
When available, donors may request third-party courier delivery (e.g., Uber Direct) to transport donations to food banks. The donor is responsible for the delivery fee. Pantry facilitates the request but is not the courier and is not liable for delivery performance, delays, or damages during transit.
All content, design, code, and trademarks on the Platform are the property of PantryDonate or its licensors. You may not reproduce, distribute, or create derivative works from our content without written permission.
To the maximum extent permitted by law, PantryDonate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, if any.
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account by contacting us. Upon termination, your right to use the Platform ceases immediately.
We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.
